Feminism, Marriage and the Law in Victorian England, 1850-95 (Paperback): Mary Lyndon Shanley Feminism, Marriage and the Law in Victorian England, 1850-95 (Paperback)
Mary Lyndon Shanley
R1,141 Discovery Miles 11 410 Ships in 9 - 15 working days

"Important both for political theorists and for women's studies. She explores with great care and thoroughness the connections between nineteenth century feminist argument and activism on the one hand, and familiar liberal principles of justice and equality on the other" - Nannerl 0. Keohane, Wellesley College Traditional studies of the women's movement in Victorian England focused on the battle for suffrage and other public rights. In this new study, however, Mary Lyndon Shanley explores how Victorian women campaigned to reform the laws which related to marriage and the married state. Arguing that without a fundamental transformation of the marriage relationship there would be no justice for women, they fought a series of campaigns to change laws governing divorce, married women's property, infanticide, protective labour legislation, child custody, wife abuse, marital rape and the "restitution of conjugal rights". Women involved in these campaigns exposed the connection between the privileged position of men in both public and private life and the reluctance of Parliament to enact the reforms women sought. In a series of case studies Shanley explores the demands of the reformers, and the response of Parliament. In an Epilogue, Shanley warns of the dangers to liberal feminism in relying exclusively on equal rights in the law as a formula for change.

Bridging the fields of political theory and history, this comprehensive study of Victorian reforms in marriage law reshapes our understanding of the feminist movement of that period. As Mary Shanley shows, Victorian feminists argued that justice for women would not follow from public rights alone, but required a fundamental transformation of the marriage relationship.

Illusion of Consent - Engaging with Carole Pateman (Hardcover): Daniel I. O’Neill, Mary Lyndon Shanley, Iris Marion Young Illusion of Consent - Engaging with Carole Pateman (Hardcover)
Daniel I. O’Neill, Mary Lyndon Shanley, Iris Marion Young
R1,535 Discovery Miles 15 350 Ships in 12 - 17 working days

For nearly four decades, the writings of Carole Pateman have been regarded as major contributions to debates within political philosophy and feminist theory. She is the recipient of the 2012 Johan Skytte Prize in political science for “in a thought-provoking way challenging established ideas about participation, sex and equality.” By critiquing conventional notions of consent at the heart of much modern political thought—hence the title for this volume—Pateman has been a central voice in discussions of such important topics as political participation and democracy, contract theory and sexual equality, liberalism and the problem of political obligation, and most recently social citizenship, welfare, and basic income. These essays, all prepared especially for this volume, deal with issues that have been central to Pateman’s work. The authors critically engage with her work while making their own original contributions and advancing ongoing debates.

Mill's The Subjection of Women - Critical Essays (Paperback, New): Maria H. Morales Mill's The Subjection of Women - Critical Essays (Paperback, New)
Maria H. Morales; Contributions by Wendy Donner, Keith Burgess-Jackson, Julia Annas, Susan Moller Okin, …
R1,514 Discovery Miles 15 140 Ships in 10 - 15 working days

John Stuart Mill's The Subjection of Women is a landmark work both in the long history of women's struggles for political, legal, economic, and personal equality, and in the shorter history of rigorous intellectual analyses of women's subordination. One of the lasting legacies of Mill's The Subjection of Women is its careful argument for the need for justice at both the 'public' and the 'private' levels, which requires changes at the domestic level that are as radical in the 21st century as they were in the 19th. The essays collected in this critical edition represent a variety of interpretations both of the kind of feminism Mill represents and of the specific arguments he offers in The Subjection of Women including their lexical ordering and relative merit. Each selection is preceded by a brief and useful summary of the author's position, intended to assist readers encountering the material for the first time

Just Marriage (Paperback, New): Mary Lyndon Shanley Just Marriage (Paperback, New)
Mary Lyndon Shanley; Edited by Joshua Cohen, Deborah Chasman
R1,510 Discovery Miles 15 100 Ships in 10 - 15 working days

From the ground breaking legal decisions on gay marriage to the promotion of marriage for low-income families, the "sacred institution" of marriage has turned into a public battleground. Who should be allowed to marry and is marriage a public or private act? Should marriage be abandoned completely? Or should marriage be redefined as a civil institution that promotes sexual and racial equality?
As the fierce national debate over same-sex marriage and civil unions continues, Mary Lyndon Shanley argues that while the state should continue to play a role in regulating personal relations, the law must be fundamentally reformed if marriage is to become a more just institution. Fourteen prominent writers and thinkers respond, including Nancy F. Cott, William N. Eskridge, Jr., Amitai Etzioni, Martha Albertson Fineman, and Cass R. Sunstein.
